Welcome to Ludo (https://ludo.com.mt) (the “Site”) and our end-to-end encrypted WhatsApp chatbot interface (the “Bot”). By accessing or using the Site, the Bot, or related services (collectively, the “Services” or the “Platform”), you (“User”, “you”) agree to be bound by these Terms of Service (the “Terms”). If you do not agree, you may not use the Platform.
Ludo operates an online advertising Platform solely to facilitate the publication and promotion of third-party real-estate listings. Ludo is not a Real Estate Agent, Property Broker, Property Consultant or Branch Manager as defined in Maltese law and does not carry out regulated intermediary functions (e.g., negotiating, arranging, or concluding transactions). All marketing, negotiations and contractual dealings remain exclusively between property owners (or their duly licensed representatives) and prospective purchasers or tenants.
“Account” means the profile you create to access certain features of the Site or Bot.
“Advertising Content” means any text, images, videos, URLs or contact information you submit for publication on the Platform.
“Blocked List” means identifiers (e.g., telephone numbers) that Ludo determines—at its sole discretion—to be ineligible for any Service, including for illicit activities or repeated Terms breaches.
“Property Data” means descriptive information, photographs, pricing, location and availability supplied by listing Users.
“Services” means the Site, the Bot, and any associated software, APIs and promotional functionalities.
“Transaction” means any sale, purchase, lease or rental of real property in which Ludo has no intermediary role.
Interpretation: The singular includes the plural; headings are for convenience only; “including” means “including without limitation.”
5.4 Two-Factor & Automated Messages. By registering an Account, you consent to receive one-time codes (OTP) and service messages via WhatsApp (e.g., login codes, listing status updates, moderation results). Message frequency varies. You may opt out of non-essential messages at any time via the Bot’s “Unsubscribe” button or by replying “STOP”. Essential messages (e.g., security, legal notices) may still be sent.
Ludo may remove or redact content in breach, with or without notice.
Images must depict the property and its features clearly and lawfully. Uploading images that include any of the following is prohibited: pornography or explicit sexual content; nudity; sexualised minors (zero tolerance); hate or extremist symbols; graphic violence; self-harm; illegal goods; weapons; doxxing; or any other unlawful or offensive material. Avoid images that prominently feature identifiable persons (faces), animals, documents/IDs, or heavy advertising overlays/watermarks that obstruct the property.
We use automated tools to help detect inappropriate or non-compliant content, including explicit content, the presence of people/faces, sensitive symbols, and excessive text overlays. If an image does not comply, we may remove it automatically and without prior notice. Repeated violations may lead to listing removal, account suspension, permanent blocking, and/or reporting to competent authorities where required by law.
Uploader Warranty. You warrant you own or have rights to all images you upload and that they do not infringe third-party rights. On request, you will provide proof of rights or remove the content.
Descriptions may be drafted or refined using automated assistance for clarity and readability. You remain solely responsible for the accuracy, completeness, and legality of your listing descriptions and all details. You must review, correct, and confirm content before publishing. Ludo may edit or remove descriptions that are misleading, unlawful, or non-compliant.
The Bot facilitates secure communication between property advertisers and interested Users. Abuse, spam, or misuse is prohibited. Ludo is not responsible for third-party network performance, message delivery, or content.
By using the Bot, you authorise Ludo to send you messages related to your Account and listings, including OTPs and status updates. You can unsubscribe from non-essential updates via the Bot’s “Unsubscribe” button or by replying “STOP”. Network and carrier fees may apply.
All listed prices must be the net amount the owner intends to receive, exclusive of any agent or intermediary commissions, fees, or third-party charges. Prices must reflect the owner’s desired take-home amount. Any separate costs, if applicable, must be handled outside the listing price and disclosed independently by the parties. Listings that include or imply agent commissions are not permitted.
Clarity: Prices must reflect the owner’s intended take-home amount; any commissions or third-party fees are excluded and handled separately by the parties.
We may modify, suspend, or discontinue any feature (including experiments/betas) without notice. We strive for high availability but do not guarantee uninterrupted operation. Planned maintenance and third-party outages (e.g., WhatsApp, hosting, CDN) may affect the Services.
No Advice. Ludo provides no legal, tax, financial, or real-estate advice and owes no fiduciary duty.
“As-Is” Basis. THE SERVICES ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Limitation. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUDO’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE FEES PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR €1,000 (WHICHEVER IS LOWER). LUDO SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
Indemnification. You shall indemnify, defend and hold harmless Ludo and its officers, employees and agents from any claim arising out of (a) your breach of these Terms, (b) your Advertising Content, or (c) your misuse of the Services.
Ludo shall not be liable for delay or failure caused by events beyond its reasonable control (including acts of God, strikes, outages, governmental action, or cyber-attacks), provided Ludo uses reasonable efforts to resume performance.
You may not assign your rights or obligations without Ludo’s prior written consent. Ludo may assign or subcontract its rights or obligations at its discretion.
All notices under these Terms shall be in writing and sent to the email address registered on your Account or to Ludo via the contact form at Contact Us. Notices by Ludo are deemed received one business day after transmission.
If you believe content on the Platform infringes your rights or is unlawful, please submit a detailed notice via Contact Us including URLs, your contact details, and supporting evidence. We may remove or disable access to disputed material while we assess the claim.
These Terms are governed by the laws of Malta. Any dispute shall be subject to the exclusive jurisdiction of the Maltese courts.
Amendments. We may update these Terms at any time by publishing an updated version on this page. Changes take effect upon posting unless a later date is specified. For material changes, we may provide additional notice where feasible (e.g., banner notice or message). Your continued use of the Platform after any change constitutes acceptance.
Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and Ludo regarding the Services.
Severability. If any provision is held invalid, the remainder shall remain in full force.
Waiver. No failure or delay in enforcing any right is a waiver of that right.
